GD itself has claimed in its defence that the charges will not stand in a court of law and this is not as far-fetched as it sounds (not because they could be right but) because the Convention of Palermo could present legal problems on the main charge against the party which is the formation or operation of a criminal organization. According to the Convention, a criminal organization explicitly operates in order to gain financial or other material benefits, rather than extreme political ideologies or beliefs.
Analyzing this extremely important factor, judicial authorities are still convinced that the transformation of a criminal organization into a political party does not exclude criminal checks and administering justice.
A report by To Vima news says that although Article 29 of the Greek Constitution provides the right to form a political party, it does not in any way mean that political freedom can be used to justify the operation of a criminal organization under the cloak of a party.
They are right, but that is an interpretation and not a fact, and the legal system cannot function on interpretations but only facts.
